The Newfoundland and Labrador Teachers’ Association contended that the Western School District’s practice of requiring carpools to in-service training programs violated the collective agreement. The Arbitration Board found that the District’s practice was not a reasonable exercise of its discretion. The District applied for judicial review, asserting that the Board ought to have evaluated management’s actions for discrimination, arbitrariness and bad faith only.
The Newfoundland and Labrador Supreme Court, Trial Division (General), dismissed the application.
