R. v. Bolianatz (N.C.) 2012 ABCA 238
Criminal Law - Procedure - Charge or directions - Jury or judge alone - Directions re evidence of character or credibility of accused
Bolianatz was convicted of nine counts involving the sexual abuse between 1998 and 2004 of two children who were daughters of a family friend. She was originally jointly charged with her husband in the offences. He committed suicide between the start of the trial and the resumption of the trial. Bolianatz’s position at trial and on this appeal was that the complainants were not telling the truth when they implicated her as a party to her husband’s crimes. Three areas of argument were presented.
The Alberta Court of Appeal dismissed the appeal.
